Thirteen republican attorney generals are threatening to sue the federal government if the provision that was granted to Bob Nelson.
Republican attorneys general in 13 states say congressional leaders must remove Nebraska's political deal from the federal health care overhaul bill or face legal action, according to a letter provided to The Associated Press Wednesday.
"We believe this provision is constitutionally flawed," South Carolina Attorney General Henry McMaster and the 12 other attorneys general wrote in the letter to be sent Wednesday night to House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid.

"As chief legal officers of our states we are contemplating a legal challenge to this provision and we ask you to take action to render this challenge unnecessary by striking that provision," they wrote.
What is confusing to me is, why not be against the bill en toto? Why just an earmark/bribe provision? With all the talk from Gov. Perry of Texas, this seems a little weak. It is like, "we didn't get our cut, so we'll whine about it until either you take away their candy or give us some". May be it's just low hanging fruit with which to break balls over, but somehow it seems weak for that. Or is it to weaken Bob Nelson? That's a lot or work to unseat a senator that is already down 30% in the polls. If this is all the GOP has to stand on, it's kind of lame. I mean, Harry Reid will willing throw Nelson under the bus with this and remove it or weaken it, just to get the AGs off his back. Then what? Like I said, it seems weak.

While I commend these 13 attorney generals, it would be nice to have a 2/3 majority taking the same action and then force an Article V Constitutional Convention.
Well, you could say good bye to the second amendment.
While I am thankful that the 13 attorney generals are standing up against this bill for any reason I wish they would stand on principle and be against the bill, period. Although, this could be one of the provisions that renders this bill unconstitutonal in the courts.
